The case came about when two inmates sued the state over the administering of lethal injections after it took 34 minutes (twice the normal time) for an injection to kill convicted killer Angel Diaz. However, it was later discovered that the "execution, not the underlying procedure, was the problem," says the Associated Press.
Because of the ruling, Mark Dean Schwab, one of the inmates who sued the state, is scheduled for execution on November 15.
"At this time, there is nothing prohibiting Schwab's execution from taking place as scheduled," said Attorney General Bill McCollum's spokeswoman, Sandi Copes.
What the state has decided to do, however, is improve staffing and training for executions so inmates will not have to suffer "painful deaths" like Diaz.
