The Senate approved the new changes on 49-1 vote. Previously, in 2007, the Senate unanimously approved a similar change. This time, the only opposition to the new changes was Sen. Merlin Bartz, R-Grafton, Clear Lake district, whose area consists of one of the state's most popular water recreational regions. Only recently has the state started to enforce the alcohol related laws to boaters enforced by the Iowa's Department of Natural Resources (DNR).
Sen. David Johnson revealed that the DNR doesn’t utilize many of methods that ground police use to apprehend offenders such as roadblocks, however they will intervene if it is evident that a boat operator is under the influence of alcohol or involved in a collision.
Sen. Johnson cited statistics from 2007 and 2008 that a total of 61 boaters were arrested and charged with drunkenness with blood level readings between 0.08 and 0.10. Although boaters could legally operate their boats under the old limit of 0.10, they could be charged with drunk driving once they pulled their vessel out of the water and attempted to operate a motor vehicle.
