The proposed mosque generated another law suit on Friday after the New York Transit Authority refused to run an unmodified version of an ad opposing the building of the mosque on city busses. The ad, which shows the twin towers in flames with a plane flying toward them and an artist's rendition of the proposed mosque prominently bearing the crescent moon associated with Islam, was paid for by the American Freedom Defense Initiative (FDI). There is a certain irony in a ground claiming to defend freedom taking a position that would seem counter to the 1st Amendment (and it's worth noting that the Anti Defamation League has also spoken out against the mosque). The MTA originally agreed to run the ad only if the plane and the flames were removed.
The FDI sued claiming that the MTA was suppressing their viewpoint - in other words, the FDI claimed a first amendment right to advocate for the suppression of another group's first amendment rights. Which is, I suppose, their right. The MTA agreed on Monday, determining that after further review the ad meets their guidelines and will now be running the ad in its original form.
