Application Deadline Extended for Upcoming Vacancy on New York Court of Appeals

On Monday, the New York State Commission on Judicial Nomination informed the public that the deadline for applying to the post of a judge on the New York Court of Appeals has been extended to August 15.

According to Norman Kee, one of the lawyers of the commission, the deadline was extended in part to ensure that no one felt rushed, and because of high interest in the position.

The vacancy would be created because Judge Carmen Beauchamp Ciparick would be reaching 70, the mandatory age of retirement for Court of Appeals judges in New York. The other six judges would also be retiring in the next five years.

To find a suitable candidate for the position, the commission had held a series of public events this year for raising awareness. Unlike justices in the Appellate Division, any suitable candidate who has been admitted to the state bar for 10 years may fill the post. The candidate need not have experience in the bench and may also be from the academia. According to Kee, the commission had in the past, fielded requests for applications from a large number of academics and non-judicial government lawyers.

The commission is expected to conduct background checks of candidates and complete the short listing process this fall. After all interviews and primary processes are completed, a final list of three to seven candidates would be made and sent to Governor Andrew Cuomo by December 1. The Governor would then need to choose and nominate the candidate destined to fill the chair left vacant by Beauchamp.

The current New York State Commission on Judicial Nomination has 12 members appointed by the governor, the chief judge, and the Democratic and Republican leaders of both the state assembly and Senate.
